a One is judged by one's own receptivity to the doings of God. See also Jn. 12:48.
b there are 2 participles and 2 very different corresponding verb tenses about judgment associated with those partciples: πιστεύων (the believing one participle ) is NOT being judged κρινεται (present mediopassive indicative verb).... HOWEVER the NOT believing one (μη πιστεύων present active participle) has ALREADY been judged κεκριται (perfect mediopassive indicative verb) <-- this judgment is a done deal.
In John 5:24 Jesus further elaborates on the dynamic of how the believing one passes out of completed judgment into eternal life: Jesus says that the one HEARING (present active participle) His Word and BELIEVING (present active participle) in the One who sent Him has(present active indicative verb) eternal life and is not coming (present medio passive) into judgment but has PASSED (perfect active indicative verb) out of death into life... PERFECT ACTIVE INDICATIVE means the action is complete, the action was not mediopassively done to the believing one, nor is the action imperfectly ongoing, rather the believing one has passed out of death into THE life bc he is believing (<--- participles matter!!)
